  1. GENERAL TERMS OF SERVICE (GTS)

  2. AKPBF – Waste Collection and Management
  3. Article 1 – Purpose
  4. These General Terms of Service govern all services provided by AKPBF, including the collection, transport, treatment and removal of waste (household waste, recyclable waste, bulky items and similar waste) from its private and professional customers.
  5. Article 2 – Acceptance of Terms
  6. Any subscription to an AKPBF service implies full, complete and unreserved acceptance of these General Terms of Service.
  7. These terms prevail over any other document or agreement issued by the Customer.
  8. Article 3 – Provision of Waste
  9. The Customer undertakes to make the waste available in the bins, bags or containers supplied or approved by AKPBF, on the days, times and locations specified in the contract or collection schedule.
  10. The waste must be:

    • placed at the roadside in an accessible location,

    • visible and free of access obstacles,

    • ready for collection at the scheduled time.

  11. Any failure by the Customer (bin not placed out, blocked access, delayed provision, etc.) will result in the impossibility of collection. In such case, the service will be considered as performed and invoiced accordingly.

    AKPBF is not required to make an additional collection round if the instructions are not followed.

    Article 4 – Collection Arrangements

    Collection is carried out according to the schedule communicated to the Customer.

    Waste may only be deposited in the authorised containers.

    The following are strictly prohibited:

    • hazardous or toxic waste,

    • medical waste,

    • asbestos,

    • chemicals,

    • heavy rubble,

    • electronic equipment (unless a specific agreement has been made).

  12. Any breach may lead to refusal of collection or additional invoicing.

    Article 5 – Customer’s Obligations

    The Customer undertakes to:

    • guarantee free and secure access to the bins,

    • comply with the sorting rules defined by AKPBF,

    • use only the authorised containers,

    • report any anomaly (damaged bin, collection not carried out) within 48 hours.

  13. Article 6 – Prices and Invoicing

    Services are invoiced according to the rates in force at the time of subscription.

    Invoices may be issued monthly, quarterly or according to the subscription plan chosen.

    In the event of late payment:

    • penalties equal to three times the statutory interest rate will be applied,

    • a fixed indemnity of 500 CFA francs for collection costs will be due.

  14. AKPBF reserves the right to suspend or limit services in the event of prolonged non-payment.

    Article 7 – Liability

    AKPBF cannot be held liable in the following cases:

    • force majeure (adverse weather, strikes, road blockages, etc.),

    • failure by the Customer to follow sorting instructions,

    • impossible access to the collection point,

    • damage to or loss of bins attributable to the Customer or a third party.

  15. Article 8 – Duration and Termination

    The contract is concluded for a fixed or indefinite term depending on the chosen offer, with automatic renewal unless terminated.

    Termination must be notified in writing with a notice period of 2 months before the expiry date, by registered letter or official email.

    AKPBF may suspend or terminate the contract in the event of repeated non‑payment or serious breach of contractual obligations.

    Article 9 – Complaints

    Any complaint must be sent in writing to AKPBF (email or official letter) within 8 working days of the service concerned.

    After this period, no complaint can be taken into account.

    Article 10 – Applicable Law and Disputes

    These General Terms of Service are governed by the law applicable in the country where AKPBF operates.

    In the event of a dispute, the parties undertake to seek an amicable solution before any legal proceedings.

    Failing an amicable agreement, the dispute shall be submitted to the competent courts.
